These Terms & Conditions ("Terms") govern your access to and use of www.cloudfom.com and its suite of applications, including DocLab, AudioLab, PhotoLab, VideoLab, Studio, Lyrics, FindASong, SceneAdopt AI, and HairVisionAI (collectively, the "Services"), provided by cloudfōm ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By using any part of the Services, you confirm that you are able to form a binding contract, that you accept these Terms, and that you agree to comply with them. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

cloudfōm provides a collection of browser-based tools for editing and creating documents, audio, photos, video, music, lyric videos, and AI-assisted content, along with related informational content and analytics features. The Services are provided on an "as available" basis and may be updated, modified, or discontinued, in whole or in part, at our discretion.

3. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Upload, process, or distribute content that is illegal, infringing, defamatory, obscene, or otherwise harmful;
  • Use the Services to violate the intellectual property, privacy, or other rights of any third party;
  • Attempt to gain unauthorized access to the Services, other users' accounts, or our underlying systems and networks;
  • Interfere with or disrupt the integrity or performance of the Services, including through malware, scraping, or excessive automated requests;
  • Use the Services to generate or distribute spam, or to circumvent advertising, security, or usage limitations we put in place;
  • Reverse engineer, decompile, or attempt to extract the source code of the Services, except where permitted by law.

We reserve the right to investigate suspected violations of these Terms and to take appropriate action, including suspending or terminating access to the Services.

4. Your Content

You retain ownership of any files, text, images, audio, or other content you upload or create using the Services ("Your Content"). By submitting Your Content to the Services, you grant us a limited, non-exclusive license to host, process, and display Your Content solely as necessary to provide the requested functionality. You are solely responsible for Your Content and for ensuring you have the necessary rights to upload and process it.

5. Intellectual Property

The Services, including their design, text, graphics, logos, icons, software, and underlying technology, are owned by cloudfōm or our licensors and are protected by intellectual property laws. Except for Your Content, nothing in these Terms grants you any right, title, or interest in the Services, and you may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

6. Third-Party Services and Advertising

The Services may display advertisements served by third-party advertising networks and may integrate with third-party analytics or infrastructure providers. We are not responsible for the content, accuracy, or practices of third-party advertisers or services, and your interactions with them are solely between you and the applicable third party.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, completeness, or reliability of any output produced through the Services, including AI-generated content.

8. Limitation of Liability

To the fullest extent permitted by applicable law, cloudfōm and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of, or inability to use, the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Services shall not exceed the amount, if any, you paid us in the twelve (12) months preceding the claim, or one hundred US dollars (US $100), whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless cloudfōm and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, Your Content, or your violation of these Terms or applicable law.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate. You may stop using the Services at any time. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts, except where applicable consumer protection law provides otherwise.

12. Changes to These Terms

We may revise these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
